C-680/21 Royal Antwerp Football Club - Football: The rules of UEFA and the Belgian football association on ‘home[1]grown players’ could be contrary to EU law. A footballer and a Belgian club are challenging UEFA’s rules and those of the Belgian football association that require a minimum number of ‘home-grown players’ to be included in teams. The Court holds that that requirementcould infringe both competition rules and the free movement of workers. However, the national court in charge of the case will have to verify whether or not that is the case.
C-333/21 European Superleague Company - The FIFA and UEFA rules on prior approval of interclub football competitions, such as the Super League, are contrary to EU law. They are contrary to competition law and the freedom to provide services. The FIFA and UEFA rules making any new interclub football project subject to their prior approval, such as the Super League, and prohibiting clubs and players from playing in those competitions, are unlawful. There is no framework for the FIFA and UEFA rules ensuring that they are transparent, objective, non-discriminatory and proportionate. Similarly, the rules giving FIFA and UEFA exclusive control over the commercial exploitation of the rights related to those competitions are such as to restrict competition, given their importance for the media, consumers and television viewers in the European Union.
C-124/21 P International Skating Union v. Commission - The rules of the International Skating Union on the prior authorisation of skating competitions infringe EU law. They have the object of restricting competition to the detriment, in particular, of athletes, consumers and audiences. Following the European Commission and the General Court, the Court of Justice confirms that the rules of the International Skating Union, which empower it to subject international skating competitions to its approval and to impose severe penalties on athletes who take part in unauthorised competitions, are unlawful because they are not subject to any guarantee ensuring that they are transparent, objective, non-discriminatory and proportionate. They give the ISU a clear advantage over its competitors and have unfavourable effects for athletes as well as consumers and broadcast audiences.
C-167/22 Commission v. Denmark (Maximum parking time) – Failure of a Member State to fulfil obligations: The Court of Justice dismisses the Commission’s action against Denmark concerning the maximum parking time on motorway lay-bys.
C-261/22 GN (Ground for refusal based on the best interests of the child) – European arrest warrant: The surrender of a requested person cannot be refused on the sole ground that she is the mother of young children. It is only where there are systemic or generalised deficiencies in the issuing Member State and where there is a risk of breach of the fundamental rights of the persons concerned that such a surrender may exceptionally be refused. A court cannot refuse to execute an European arrest warrant (EAW) on the sole ground that the requested person is the mother of young children living with her. However, that court may exceptionally refuse that person’s surrender if two conditions are satisfied: first, there must be a real risk of breach of the mother’s fundamental right to respect for her private and family life and of disregard for the best interests of her children, on account of systemic or generalised deficiencies in the conditions of detention of mothers of young children and of the care of those children in the State issuing the EAW, and second, there must be substantial grounds for believing that, in the light of their personal situation, the persons concerned will run that risk on account of those conditions.
C-718/21 Krajowa Rada Sądownictwa (Continued holding of a judicial office) - Polish judicial system: An adjudicating panel of the Extraordinary Review and Public Affairs Chamber of the Supreme Court does not constitute an independent and impartial tribunal previously established by law. The request for a preliminary ruling submitted by that adjudicating panel is consequently, declared inadmissible. In view of all the circumstances connected with the appointment of judges of the Extraordinary Review and Public Affairs Chamber of the Polish Supreme Court, an adjudicating panel of that chamber does not constitute a ‘court or tribunal’ for the purposes of EU law. Consequently, the Court of Justice does not examine the substance of the questions for a preliminary ruling raised by that body.
C-38/21, C-47/21 og C-232/21 BMW Bank and Others - A consumer who concludes a car leasing agreement without an obligation to purchase does not have a right of withdrawal. By contrast, a consumer who has concluded a credit agreement in order to purchase a car without being properly informed of his or her rights and obligations may withdraw at any point so long as he or she has not received complete and correct information, provided that the withdrawal occurs before the agreement is performed in full. The Court explains consumer rights as regards leasing and car loans. In the case of a car leasing agreement without an obligation to purchase, a consumer’s right of withdrawal does not stem from EU law. By contrast, in the case of a credit agreement concluded in order to purchase a car, a consumer may, without committing an abuse of rights, exercise his or her right of withdrawal at any point so long as he or she has not received complete and correct information on his or her rights and obligations and provided that the agreement is still being performed, namely, typically, before the final repayment.
